Under the direction of the Director, Legal Services, the Legal Counsel provides legal advice and interpretation to the President and staff and represents our client on assigned cases.
What you will be doing:
- Assist the Director, Legal Services in providing legal advice on Member and corporate matters.
- Conduct research and provide recommendations on labour relations, Code of Conduct, and other legal matters.
- Investigate and analyze emerging trends related to the implementation of the Collective Agreement, assess their impact on the organization and its Members and evaluate their importance for existing interpretations, policies, and procedures.
- Research, analyze and recommend corporate positions in defense of grievances and arbitrations.
- Provide advice and leadership on the grievance process, including referrals to arbitration.
- Participate in the development, maintenance, and continued enhancement of the organization's legal case management system.
- Provide direction to the external counsel on the disposition of referred cases.
- Provide legal advice and interpretation to staff regarding the Collective Agreement and related grievances and adjudication, relevant policies, applicable legislation, and legal matters, related to the representation of individual Members.
- Prepare legal information and documentation to support staff on issues affecting the organization and its Membership.
- Conduct and participate in training seminars for staff on legislation, policies, legal cases, and precedents.
- Draft submissions to support proceedings before administrative tribunals and courts.
- Plea before administrative tribunals and courts.
- Conduct formal and informal dispute resolution processes.
- Perform the full range of other related duties, as required by the Office of the General Counsel.
- Completion of a law degree and membership in a provincial or territorial law society
- A minimum of 2-4 years of relevant experience in labour law
- Bilingualism (French and English) is an asset
- Must be eligible for a Top Secret (Level III) security clearance
- A thorough knowledge of relevant labour relations processes, including collective bargaining, grievances, arbitration, negotiations, and consultation
- Proven ability to conduct legal research, analyze complex issues and provide legal advice
- A well-developed capacity to represent the organization and its Members before administrative tribunals and courts
